By the Bay Health (“us,” “we,” or “our”) operates this website (the “Site”). This page informs you of our policies regarding the collection, use and disclosure of Personal Information we receive from users of the Site.
We have a firm commitment to maintain the privacy of your personal information online. We do not collect personally identifying information about you when you visit our Site, unless you choose to provide such information to us or unless it is collected automatically as described below. Providing personally identifying information directly to us is voluntary. As described in more detail in this Privacy Policy, we do share certain categories of information with select service providers and technology vendors (for example, our donation processing platform and website analytics and advertising tools) who assist us in operating the Site and our programs. We do not sell personal information, and we do not share personal information with unaffiliated third parties for their own independent marketing purposes without disclosing that practice to you as described below, except in response to a subpoena, court order, or other valid legal process, or as otherwise required by law.
Please do not submit personal health or medical information about yourself or anyone else through this Site.
By using the Site, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible on this website. This policy is your guide to how we will handle information we learn about you from your visit to our website.
Like many website operators, we collect information that your browser sends whenever you visit our Site (“Log Data”). This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, which pages of our Site you visit, the time and date of your visit, the time spent on those pages and other statistics. We use this information to help us make our Site better for our visitors.
If you choose to complete My Email Preferences, you are sharing personally identifying information. We use this information to send you information about By the Bay Health activities or messaging related to our mission and programs, and to operate the email platform through which we communicate with you. We do not give this information to other agencies or individuals for their own independent purposes, except: (a) to service providers who help us operate our email and communications systems, (b) as described elsewhere in this Privacy Policy, or (c) as required by law.
You may send us personally identifying information, for example, through an email link on our Site that contains a question or comment, by filling out our Contact Us form, by signing up for our newsletter, by downloading a resource such as an eBook, by filling out a volunteer application, or by making a donation. We use that information to respond to your requests and to operate our programs. We may forward your message to other personnel who can better answer your questions. We may also use your information to contact you about our programs that may be of interest.
Please do not use these forms, or any other form or free-text field on the Site, to submit personal health or medical information about yourself or a family member (for example, a diagnosis, treatment details, medication information, or medical record information); if you are inquiring about care for yourself or a loved one, please call us directly at the phone numbers provided on our Contact Us page, where our team can discuss your situation over a more secure channel.
We disclose certain categories of the personal information described in this Section 1 (typically identifiers and internet activity information) to service providers that help us operate the Site and our programs, including our website hosting and analytics providers, the advertising platforms described in Section 3 below, and our email/communications platform described above. Donations made through the Site are processed by our donation platform, GoFundMe Pro, through pages or widgets that GoFundMe Pro hosts or operates; By the Bay Health does not directly receive or store your credit card or other payment card numbers, which are collected and processed by GoFundMe Pro subject to GoFundMe Pro’s own privacy policy, available at https://pro.gofundme.com/c/legal/privacy-notice/. We do not sell personal information. Our advertising cookies and pixels, described in Section 3 below, are used for interest-based advertising. Except as described in this Privacy Policy or as required by law, we do not share your information with parties outside our organization and its affiliated hospice and home care programs.
The security of your Personal Information is important to us, but no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.
This is why we do not recommend that you email personal health or medical information about yourself or someone else (including name, address, diagnosis, or similar details) or submit such information through this Site. As a provider of hospice, palliative, and home health care services, By the Bay Health is subject to the California Confidentiality of Medical Information Act and, for patients and their care, to the Health Insurance Portability and Accountability Act (HIPAA). Our practices regarding protected health information collected in the course of providing care are described in our separate Notice of Privacy Practices, which is available upon request and, where applicable, on our website, and are not superseded by this Privacy Policy, which addresses information collected through this website.
Our Site uses cookies and similar tracking technologies, which are small data files stored on your device, to help us understand how visitors use the Site and, in some cases, to support advertising. We and our third-party service providers currently use the following categories of cookies and similar tracking technologies on the Site: (a) analytics cookies (such as Google Analytics) to understand how visitors use the Site; (b) advertising cookies and pixels (such as Google Ads remarketing tags, the Meta/Facebook Ads pixel, and the LinkedIn Insight Tag) that may be used to measure the effectiveness of our advertising and, in some cases, to show our ads to prior visitors on other websites; (c) functional/security tools (such as Google reCAPTCHA) used to protect our forms from abuse; and (d) session-replay or click-analytics technologies, used to understand how visitors interact with the Site and to improve its usability, which may record on-site interactions, such as mouse movement, scrolling, and clicks.

Do Not Track signals: some web browsers offer a “Do Not Track” (DNT) setting. Because there is not yet an accepted industry standard for recognizing or responding to DNT signals, our Site does not currently respond differently based on a browser’s DNT signal. Other parties, including the analytics and advertising providers identified above, may collect information about your online activities over time and across different websites and devices when you visit the Site; those providers’ own privacy policies govern their independent use of that information.
Our Site may contain links to other sites that are not operated by us. If you click on a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit. By the Bay Health has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services.
Our Site allows users to opt-out of receiving email communications from us by following the unsubscribe link included in our emails, or by contacting us using the information in the “Where do I direct questions” section.

We are a nonprofit organization, and certain of California’s consumer privacy laws do not generally apply to nonprofit organizations. Shine the Light disclosure: California Civil Code Section 1798.83 permits customers who have an established business relationship with us to request certain information about our disclosure, if any, of personal information to third parties for those third parties’ own direct marketing purposes within the preceding calendar year. We do not disclose personal information to unaffiliated third parties for their own direct marketing purposes.
We do not use geofencing or similar location-based technology to identify, track, or send messages or advertisements to individuals based on their presence at or near our facilities or the facilities of health care providers, and we do not sell or share consumer health data derived from such technology.
We provide hospice, palliative, and home-based health care services, and direct our programs and fundraising, only to residents of the California counties we serve. If you are located in another U.S. state or outside the United States and have any questions about our data practices, you may still contact us using the information in the “Where do I direct questions” section.
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, such as maintaining donor and volunteer relationships, responding to inquiries, and complying with our legal and accounting obligations.
The Site is intended for use by adults. Some of our programs, including grief-support camps and pediatric palliative and hospice care services, serve or concern children. The Site’s forms are not designed for children to complete directly, and rather, with respect to children, the Site is intended for use or inquires by adults (such as parents, guardians, family members, referring providers, donors, and volunteers) acting on behalf of or in the interest of a child or family member. We do not knowingly collect personal information directly from children under 13 through the Site, consistent with the Children’s Online Privacy Protection Act (COPPA). If you believe a child under 13 has submitted personal information to us directly, please contact us using the information in the “Where do I direct questions” section so we can address it.
By the Bay Health may update this Privacy Policy from time to time to reflect changes in our practices or in applicable law. We will notify you of any material changes by posting the revised Privacy Policy on the Site and updating the effective date above. We encourage you to review this Privacy Policy periodically.
